Terms of Use

These terms are an agreement between you and Clay Crosland, the publisher of ExpeditionSpot ("we", "us"), and cover your use of the ExpeditionSpot apps and the website expeditionspot.com (together, the "Service"). By creating an account or using the Service you agree to them. Our Privacy Policy explains how we handle your information.

Rivers are dangerous. Read this first.

River running, hiking and backcountry travel can cause serious injury or death. River conditions change constantly: flows rise and fall, rapids change, trees fall across channels, camps and access points close. The river guides, maps, rapid classes, river levels, weather, agency notices and posts in ExpeditionSpot come from public sources, other users and our own writing. They can be incomplete, out of date or wrong, and some of them are written or edited by the public. Nothing in the Service is a substitute for your own training, judgment, scouting, proper equipment, and the official information and rules of the agency that manages the river. Always check with that agency before a trip. You are responsible for your own safety and for the decisions you make on the water.

Your account

• You must be at least 13 years old to use the Service, and old enough to agree to these terms where you live.
• Keep your sign-in secure. You are responsible for what happens under your account.
• You can delete your account at any time (see our account deletion page).

Your content

You keep ownership of what you create and upload: trips, recordings, photos, videos, posts and suggested edits ("your content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display and distribute your content only as needed to run the Service and to show it to the people you share it with. For content you make public or post in a river room, that includes showing it to everyone who uses the Service.

River guides are shared and improved by the community. When you suggest an edit to a river guide and it is accepted, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, edit, adapt and publish that contribution as part of the guide, including after you delete your account (it then stays in the guide without your name). Please contribute only what you have the right to share, and never copy text or images from guidebooks, websites or maps.

You are responsible for your content and must have the rights to it. Do not upload other people's photos, videos or personal information without their permission.

River rooms and community rules

River rooms are for information about the river: conditions, hazards, access, camps, flows, regulations. When you post you agree to:

• keep posts about the river and its official information;
• be truthful, especially about hazards, and not post anything intended to mislead;
• not harass, threaten, or impersonate anyone, including agency staff;
• not post anything illegal, hateful, sexually explicit or violent, or spam and advertising;
• follow the directions of the room's moderators and agency staff.

Other users can vote on posts. Posts that receive enough downvotes are removed automatically, and moderators, agency staff and we can remove posts or suggested edits and restrict accounts that break these rules. You can report content that you think breaks them.

Acceptable use

Do not misuse the Service: do not interfere with it or try to access it in ways we don't offer, scrape it, overload it, reverse engineer it except where the law allows, or use it to break any law or anyone's rights.

Information from others

The Service shows information from government agencies and other public sources (for example river gauges, weather, and permit and closure notices), copied automatically and linked to its source. We do not control those sources and are not responsible for their accuracy or availability. Always confirm important information with the source.

Changes and availability

We may change, suspend or stop any part of the Service. We will try to give notice of significant changes. We may update these terms; if a change is significant we will tell you in the app before it takes effect, and continuing to use the Service means you accept the new terms.

Ending your use

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms or if we have to for legal reasons.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY INFORMATION IN THE SERVICE IS ACCURATE, COMPLETE OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE OR LOSS ARISING FROM YOUR USE OF, OR RELIANCE ON, THE SERVICE OR ANY INFORMATION IN IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS. SOME PLACES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Indemnity

You agree to defend and hold us harmless from claims arising from your content or your breach of these terms, to the extent permitted by law.

Apple

If you use the iPhone app, these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, and is not responsible for any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

General

If any part of these terms cannot be enforced, the rest remains in effect. Our not enforcing a right is not a waiver of it. These terms are the whole agreement between you and us about the Service.
